IMMIGRATION

Fixed fees for immigration matters

We charge a fixed fee for immigration work. The fee depends on the circumstances of your case — including complexity, supporting evidence, language needs, dependants, and whether the matter is an application or an appeal.

We do not charge VAT on our fees for immigration matters.

What influences the fee

  • The type and complexity of the application or appeal
  • The amount of supporting evidence we need to consider
  • Which language(s) you speak
  • Whether you are applying with other dependants
  • Whether your matter is an application or an appeal

If you can provide sufficient evidence at our first meeting and clearly meet the applicable Immigration Rules, the cost is likely to be at the lower end of the range.

What our fee typically covers

  • Discussing your circumstances and confirming the most appropriate application
  • Advice on the Immigration Rules and whether you meet the criteria
  • Considering supporting evidence and helping obtain further evidence where needed
  • Preparing and submitting the application on your behalf
  • Advice on Home Office interviews and on the outcome of the application

Not included in our quoted fees

  • • Home Office fees for making the application (paid directly to the Home Office)
  • • Where the Home Office refuse your application, advice and assistance in relation to any appeal (unless separately agreed)
  • • Interpreter fees, independent expert reports, and travel expenses if we attend an interview with you

We cannot guarantee how long the Home Office will take to process your application. We will normally be able to submit this type of application within 2 weeks of you instructing us, and will let you know if it is likely to take longer. All applications vary — we can give a more accurate estimate once we have more information about your case.

Disbursements are costs related to your matter that are payable to third parties, such as Land Registry or search fees. We handle payment of disbursements on your behalf to ensure a smoother process.

Our fee examples assume that

  • This is a standard transaction and no unforeseen matters arise (for example a defect in title requiring remedying, or additional documents ancillary to the main transaction)
  • This is the assignment of an existing lease and not the grant of a new lease
  • The transaction is concluded in a timely manner and no unforeseen complications arise
  • All parties are co-operative and there is no unreasonable delay from third parties providing documentation
  • No indemnity policies are required (additional disbursements may apply if they are)

Factors that can affect conveyancing costs

  • Value of the property
  • First-time buyer
  • Re-mortgage
  • Freehold or leasehold
  • New build
  • First registration of title
  • Whether there is a mortgage (including Islamic mortgage)
  • Primary residence, buy-to-let or second / holiday home
  • Multiple owners
  • Shared ownership, Help to Buy, Right to Buy or auction purchase
  • Property that has been repossessed

PROBATE & WILLS

Fixed fee for probate services

2–3%

of the value of the estate, plus VAT

Typical disbursements & related fees

Probate application fee£215.00
Land Registry fee (on average)£131.00
Oath fee£10.00
Will writing£300.00 + VAT

What our probate work can include

  • Will writing — preparing a legal document to determine who will get your money, assets and possessions
  • Establishing whether a valid Will exists and contacting any solicitor who may hold one
  • Considering mental capacity at the time a Will was made, and who the executors are
  • Advising executors on obtaining a Grant of Probate
  • Where there is no valid Will, advising on intestacy rules
  • Completing probate application forms, Inland Revenue forms, drafting oaths and Land Registry forms
  • After Grant of Probate: assisting the executor to distribute assets, pay debts and liabilities, and transfer remaining assets to those entitled

How long will the process take?

  • We cannot guarantee how long it will take to obtain a Grant of Probate.
  • We would normally be able to apply to obtain probate within two weeks of our initial instructions.
  • We anticipate we will be able to obtain a Grant of Probate within three months.
  • We also assume we will be able to distribute the estate after obtaining Grant of Probate within four weeks.

Important notes

  • • All figures are taken from Binas Solicitors Ltd’s published fees information and may be updated from time to time.
  • • Stamp Duty Land Tax / Land Transaction Tax depends on the purchase price and is calculated separately via HMRC or the Welsh Revenue Authority.
  • • Please note all matters are likely to vary; we can give you a more accurate estimate once we have more information about your specific case.
